These general terms and conditions of sale apply to all products and services sold on the online sales website wk-modules.com, legally owned by PRESTAWEB, located at Cité Jardin, Bloc 14 Apt. 72, Ariana 2080, Tunisia.
The buyer acknowledges having read these terms and conditions and agrees to be bound by them in their dealings with the seller. These terms and conditions apply without restriction to all commercial transactions concluded by PrestaWeb. As a reminder, in the context of a sale to a professional, the relationship is governed by the commercial code and not by consumer law, which applies only to sales to individuals.
Consequently, the buyer acknowledges being fully aware that their agreement to the content of these general terms and conditions does not require a handwritten signature on this document, insofar as the customer wishes to order the products presented in the website's online store online.
The buyer has the option to save or print these terms and conditions, it being understood that both saving and printing this document are the buyer's sole responsibility.
Article 1: Purpose
These terms and conditions define the rights and obligations of the parties within the framework of the online sale of goods and services offered by PRESTAWEB to the buyer.
Article 2: Price
Prices are indicated in euros or dollars. Prices do not include VAT applicable on the date of the order. Payment of the full price must be made after the order by bank transfer. Under no circumstances may the sums paid be considered as a deposit or down payment.
Article 3: Payment Method
To pay for their order, the buyer has only one payment method available: payment by bank transfer. The buyer guarantees to wk-modules.com that they have all necessary authorizations to use the payment method chosen when validating the order. PRESTAWEB reserves the right to suspend order processing and delivery in the event of a refusal of payment authorization by officially accredited organizations or in the event of non-payment. PRESTAWEB specifically reserves the right to refuse to make a delivery or fulfill an order from a buyer who has not fully or partially paid for a previous order or with whom a payment dispute is pending.
Note: Our bank only accepts transfers from business (not personal) bank accounts.
Article 4: Order Processing
The customer declares having read and accepted these Terms and Conditions before placing their order. Validation of the order therefore constitutes acceptance of these Terms and Conditions. Unless proven otherwise, the data recorded by the company constitutes proof of all transactions with the customer.
The customer must verify the completeness and accuracy of the information provided to the company when placing the order, particularly the billing address. The company cannot be held liable for any data entry errors and their consequences.
The company reserves the right to block a transaction while conducting fraud prevention checks.
Article 5: Order Shipment
For all orders placed and paid for, PRESTAWEB undertakes to ship them the same day (excluding weekends and public holidays).
Modules in zip format are delivered to the email address provided by the buyer.
Article 6: Intellectual Property
The company grants each customer who has purchased a virtual product a non-exclusive, worldwide license to use it. This license is valid only once per e-commerce store. Furthermore, the customer is prohibited from reselling or using on other websites the virtual products purchased on our website wk-modules.com.
Article 7: Warranty Limitation
The company disclaims all liability in the event of loss or theft of passwords, usernames, accounts, or user information.
For each virtual product purchased, it is possible to subscribe to the paid "One Year Support" option, which extends the support period for the ordered products to 365 days (1 year) from the date of payment receipt. This allows users to benefit from future updates to the purchased products that include this option for the specified period. This applies even to major updates.
Purchasing a virtual product on wk-modules.com entitles the user to email-only support for that product for a period of 90 full days from the date of payment.
By default, installation is not included with the support service included with the purchase of virtual products unless the customer selects the (paid) option beforehand on the module's product page.
Article 8: Support and Liability in Case of Store Overrides
In the specific case where the customer's PrestaShop store contains "overrides," also known as "overloads," i.e., files located and active in the /override directory of the PrestaShop store and its subdirectories /override/classes, /override/controllers/, and /override/modules, the following procedure will be applied if one of our virtual products malfunctions:
The customer's store will be briefly placed in maintenance mode via the appropriate menu in the PrestaShop back office.
All active overrides will be deactivated via the appropriate menu in the PrestaShop back office.
The module will then be tested without the overrides.
If it turns out that the module works without the overrides, or if disabling the overrides prevents the store from functioning and therefore from testing our module without the overrides, the company will be released from all liability, and it will be the Client's technical contact (web agency, developer, webmaster, freelancer, etc.) who is responsible for ensuring the proper functioning of our virtual product with the overrides. Furthermore, no refund, partial or full, will be granted.
If, however, disabling the overrides does not resolve the issue and the module still does not work, the company will provide technical support and make every effort, as with any store without overrides, and a full refund will be issued if the problem cannot be resolved despite all efforts.
Article 9: Refunds
Refunds for the products covered by Article 8 of these Terms and Conditions will be issued within a maximum of 30 days from the date on which the right was exercised.
The refund will be issued using the same payment method as the original purchase, via bank transfer to the bank account of the customer who placed the order.
